In a scene he tests Pinocchio by aiming it at the guy, but in the next shot, you noticed that the hammer is not cocked and the action is single action, so it wouldn't be threatening and he wouldn't be able to harm Pinocchio even if he wanted to because of this fact.

(A continuity error: When the SWA comes to arrest him, the suspect shoots through the door with what sounds like a rifle or SMG, but he is seen wielding the shotgun after they break in. It's either that or the terrorist switched weapons before attempting his escape.) Priscilla in Episode 13 also uses a Benelli M3 in semi-auto in an attempt to stop Franca's car.

A Benelli M4 Super 90 is seen hanging in Pinocchio's gun closet and in the SWA armory.
